小西は「NHK内の過労死事件についてNHK会長からヒアリングを行う権限を総務大臣は放送法上有していない。それは労基署等の任務である。報道機関はこうした本質問題に敏感になって頂きたい。」とツイート。（11/1）

形式にこだわり過ぎるのは良くないかもしれないが、大臣の行為については常に適正な手続きを経ることが肝要。小西の指摘は妥当であり、労働環境に何らかの問題があったとみられていることから、ヒアリングは労基署等の任務となる。野田総務相はNHKの対応（情報の積極的な公開を拒んでいる疑い）を問題視していることは十分理解できるが、
まずは労働環境を調査し、過労死との因果関係を確認することが重要。
